1. Acceptance of Terms
By accessing or using GetMailer ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
GetMailer provides an email API service designed for transactional emails and behavior-triggered messaging—such as password resets, notifications, confirmations, welcome sequences, onboarding flows, and engagement campaigns triggered by user actions in your application. GetMailer is not intended for cold outreach, bulk promotional blasts, or sending to purchased lists. We provide tools for email delivery, tracking, analytics, and management.
3. Account Registration
To use our Service, you must create an account and provide accurate information. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access.
4. Acceptable Use
GetMailer is built for transactional and behavior-triggered emails. We support automated sequences and audience management for user-initiated communications. We reserve the right to review accounts and may decline service to users whose primary use case is cold outreach or bulk promotional campaigns. For mass marketing newsletters, we recommend dedicated platforms like Mailchimp or ConvertKit.
You agree NOT to use our Service to:
- Send unsolicited bulk email (spam)
- Send cold outreach or promotional campaigns to purchased/rented lists
- Send emails to purchased or harvested email lists
- Send phishing or fraudulent emails
- Distribute malware, viruses, or harmful content
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Harass, abuse, or harm others
- Impersonate any person or entity

5. Email Compliance
You are responsible for complying with all applicable email regulations including CAN-SPAM, GDPR, CASL, and other anti-spam laws. All marketing emails must include a valid unsubscribe mechanism and your physical mailing address.
6. Payment Terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change pricing with 30 days notice.
7. Service Level
We strive to maintain 99.99% uptime for our email API service. While we aim to provide continuous service, we are not liable for any delays, failures, or interruptions in service beyond our reasonable control.
8. Intellectual Property
The Service, including its design, features, and content, is owned by GetMailer and protected by intellectual property laws. You retain ownership of your email content and data.
9. Limitation of Liability
To the maximum extent permitted by law, GetMailer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
10. Termination
We may suspend or terminate your account for violation of these terms or for any other reason at our discretion. You may cancel your account at any time through your dashboard settings.
11. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
